Privacy Policy

This privacy policy (the “Privacy Policy” or the “Policy”) is entered into by and between you and Creative Confidence Management Consulting Company S.P.C. (“Creative Confidence” “we”, “our”, or “us”), the legal entity that operates the Bida mobile application (the “Bida App” or the “App”).

We recognize the importance of protecting the privacy and personal information of our users of the Bida App, who may include parents, legal guardians, family members or caregivers of children, or other authorized individuals who may download the App (each a “User” and collectively, the “Users”), as well as the privacy and personal information of the child (the “Child” or “Children”) provided by the User. We take this responsibility seriously. This Privacy Policy explains how we collect, use, disclose and retain our Users’ and the Children’s information when Users access or use the Bida App as part of the Bida platform (the “Bida Platform”).

Please read this Privacy Policy carefully before using the App. By accessing or using the App, you acknowledge that you have read, understood and agree with the terms of this Policy. If you do not agree with the terms of this Privacy Policy or the manner in which we process personal information, you should not access or use the App or provide us with any personal information. You should also delete the App if you have downloaded the same onto your smart phone or electronic device.

Bida Platform

The Bida Platform is an educational and awareness platform designed to support parents or legal guardians in tracking and understanding early childhood development and developmental milestones in newborns up until around the age of six. The App allows Users to create profiles of the Children in their care (the “Child Profile(s)”), track milestones of the Child across multiple development domains, access educational content and activity recommendations, receive reminders, track vaccination status and generate progress summaries for personal reference, as well as other features as highlighted under this Privacy Policy and our Terms of Use.

The Bida Platform is solely intended to promote parental awareness and engagement with child development tracking, and does not aim to provide medical, diagnostic or clinical assessments, nor does it aim to replace the services of a professional healthcare provider or any other child development professional or practitioner.

Collection of Information

Collection of Personal Information

The App may collect personal information relating to both the Users and the Children whose information is manually entered into and automatically processed by the App (“Personal Information”). The App may collect the following categories of Personal Information:

“Child Profile Information”When you create a Child Profile, we may collect information relating to the Child as provided by the User, including name or nickname, date of birth, age, gender, information relating to premature birth (where applicable), and other profile details entered for identification and tracking purposes.
“Milestone and Developmental Inputs”Responses provided by Users for age-related milestone questions across multiple developmental domains, including communication, gross motor skills, fine motor skills, problem solving, and personal-social development, together with related observations.
“Generated Progress Summaries and Reports”Consolidated summaries, reports and visual progress indicators generated by the App based on user-provided information, including downloadable or shareable reports in PDF format.
“Health and Vaccination Information”Information relating to the Child’s vaccination status, medication, immunization history, height and weight, health concerns, allergies, and observations related to the Child’s gross motor, fine motor and problem-solving skills, as well as limited health-related information in the form of premature birth or developmental observations. This information is voluntarily provided by the User.
“Notes, Media, and User-Generated Content”Personal notes, text entries, photographs, videos, documents, and other materials created or uploaded by Users relating to the Child’s development, growth, health, or activities.
“Location and Regional Information”General location information, specifically the governorate or city where the User and the Child are located.
“Technical and Usage Information”Device identifiers, Internal Protocol (IP) addresses, operating system, log data and connection timestamps.
“Analytics and Performance Data”Anonymized or aggregated information relating to App usage patterns, feature interaction, error reports and system performance.

The User(s) have the right to:

  • be notified, upon your request, of the complete data we have collected concerning such User and the related Child to request its rectification, noting that certain information is already accessible to the User within the App through the transaction history or similar in-App records, and
  • object to the processing of the User’s and the related Child’s personal data for the purpose of direct marketing free of charge (although the App does not engage in such activities), including when the User’s and the Child’s personal data is publicly available.

Device Information, Local Storage and Similar Technologies

The App does not use traditional browser cookies. However, it may use equivalent technologies to ensure proper functionality, security, and performance, and offline access. These may include local storage, device identifiers (“Device IDs”) that are accessible by mobile applications, including the Bida App, and analytics tools that help us understand how the App is used and to improve the Bida Platform.

To enhance performance and enable offline functionality, the App stores a limited local copy of certain User and Child Personal Information on the User’s device. This locally stored data reflects the most recent synchronized server state and is maintained solely for operational purposes. Such data is stored within the App’s private storage directory, which is accessible only to the App and is not available to other applications on the device.

Attachments created or uploaded by Users (including notes, photographs, videos, or documents) are stored within the App’s private storage directory. The App’s internal database retains only the file path and limited metadata relating to such attachments and does not duplicate the file contents within the database itself. The primary record of User and Child information remains stored on secure servers operated by or on behalf of Creative Confidence.

If you use the App on your iOS or Android device, we may collect and store limited technical data, such as your Device ID, device type, operating system, App version and general usage statistics. This information is used solely for internal administrative, diagnostic and analytical purposes and is not linked to your or the Child’s personal identity.

You can manage your device settings to control permissions and limit certain types of data collection, such as analytics tracking. We do not use any tracking technology for advertising, profiling or marketing purposes.

Use of Information

We use Personal Information provided through the App for the purposes of operating, maintaining, and improving the App and the Bida Platform. This includes enabling Users to create and manage their accounts and the Child Profiles you create, access educational content and activity recommendations, track developmental milestones, receive reminders, generate progress summaries, and engage with the App in accordance with its intended educational and informational purpose.

Health and Vaccination InformationTo enable vaccination tracking, generate reminders, support health-related record-keeping. We may track the number of Users who use this feature, with such information stored in an aggregated and de-identified form. We do not use this information for diagnostic or clinical assessments, nor do we aim to replace the services of a professional healthcare provider or any other child development professional or practitioner.
Notes, Media, and User-Generated ContentTo allow Users to create, organize, store, and review personal observations and materials relating to the Child’s development, growth, and activities, for the purposes of assessing and improving this feature.
Location and Regional InformationTo display and facilitate access to relevant services, clinics and other resources based on geographical area. We use this information solely as a tool for informing the User of available resources in their respective area. This information is not used to generate any medical referrals or other type of referral instrument which would otherwise be produced by a licensed medical professional.
Technical and Usage InformationTo help us understand how the App is used and to improve the Bida Platform.
Analytics and Performance DataTo help us monitor system performance and to ensure that the App is running smoothly. This information is used for administrative, diagnostic and analytical purposes for the App and is not linked to your personal identity.

In addition, we may also analyze aggregated and de-identified information (which does not identify any individual User or Child Profile) to derive insights, behavioral analytics, and usage trends. Such information may be used internally to enhance our services or, in anonymized and statistical form only, for commercial, educational or research purposes. We do not sell or otherwise monetize identifiable Personal Information of Users or Children, and we do not use Personal Information of the Users and/or Children for targeted advertising or marketing.

All processing of User and Children Personal Information is conducted in accordance with applicable data-protection laws and app store policies, and, where relevant and applicable, on the basis of legitimate interest, consent or contractual necessity.

Disclosure of Your Personal Information to Third Parties

We may share certain Personal Information we collect or receive with trusted third-party service providers who assist us in operating, hosting, storing, securing, maintaining and improving the App and the Bida Platform, including providers of data-storage, security, and analytics services. These service providers are given access only to the Personal Information necessary to perform their specific functions and they are expected to protect the Personal Information and use it solely for the purpose of supporting the App and Bida Platform.

Any third party service providers, including those that deploy analytics tools, hosting systems, or software development kits (SDKs), as well as any parent, subsidiary, or related entities that may access the Personal Information of a User or Child, are expected to provide the same or greater level of protection for Personal Information as described in this Privacy Policy and as required under the applicable app store guidelines and relevant data protection laws. While we select such providers with care and take reasonable steps to verify their compliance, we do not independently audit or guarantee their practices. Accordingly, Creative Confidence is not responsible for any acts, omissions, or failures of these third parties beyond its reasonable control.

In certain limited circumstances, we may access or disclose Personal Information to: (i) protect the safety, security, and privacy of Users of the App and the related Children or members of the public, including in emergency situations; (ii) protect or defend the legal rights or property of Creative Confidence; or (iii) comply with applicable law, regulation, or legal process.

We may also allow certain third-party analytics providers to collect or access the Personal Information to help us understand how the App is used and to support ongoing improvement of both the App and Bida Platform. These providers may process or store limited Personal Information, to the extent required, strictly on our behalf for such analytics or research purposes, and are expected to handle such information confidentially and in accordance with applicable data-protection laws and regulations.

We may share anonymized or aggregated analytics outputs (which do not identify any individual User or Child) with third-party research partners, educational institutions, or commercial collaborators to advance child development insights or Platform development. Such sharing will never include identifiable data relating to minors.

To the fullest extent permitted by applicable law, Creative Confidence shall not be liable for any loss, damage, or harm, whether direct, indirect, incidental, or consequential, arising from or related to the acts, omissions, data-handling practices, or security measures of any third-party service providers, analytics partners, hosting entities, software vendors, or any other third parties engaged in or supporting the operation of the Bida Platform, that may process or access Personal Information in connection with the App. While Creative Confidence exercises reasonable care in selecting and engaging such third parties, it does not control their operations and disclaims all responsibility for any unauthorized use, disclosure, or other processing of Personal Information outside its control.

By accepting this Privacy Policy, you agree and consent to us providing third parties with any and all of your Personal Information for the purposes highlighted above, including the processing of anonymized and aggregated information for research, educational, and analytical purposes, provided that such information does not identify any individual User or Child.

Cross Border Transfers of Personal Information

You as a parent/legal guardian, family member, caregiver, or any other authorized individual who, as the case may be, has created an account and Child Profile for a respective Child, understand and agree that the Personal Information of the User and Child may be stored or processed, as the case may be, by our trusted third-party service providers operating data servers located outside the State of Kuwait. In such cases, we ensure that the transfer of User’s and/or Child’s Personal Information complies with applicable Kuwaiti data-protection laws and that adequate safeguards—such as contractual undertakings, encryption, or equivalent protective measures—are in place to ensure a level of protection consistent with this Privacy Policy. Where User’s Personal Information is transferred internationally, our service providers are required to process such data solely for the purposes of supporting the App and the Bida Platform or for legitimate, anonymized research and analytical purposes as described above and in accordance with the confidentiality and security standards described herein.

By accepting this Policy, as a parent/legal guardian, family member, caregiver, or any other individual who, as the case may be, is authorized to and has created an account and Child Profile for a respective Child, you agree and consent to any and all cross border data transfers conducted by us or on our behalf.

Data Retention

We retain User’s and the Children’s Personal Information only for as long as necessary to fulfil the educational, operational and research purposes of the Bida Platform, in compliance with applicable laws, regulations and contractual obligations. Once the Personal Information is no longer required for these purposes, it is securely deleted or anonymized.

Users may also request the correction or deletion of its or a related Child’s Personal Information at any time by contacting Creative Confidence through the support channels provided within the App or via the contact details listed at the end of this Privacy Policy. Requests for data deletion or correction, or the withdrawal of consent will be processed subject to applicable legal and regulatory record-keeping requirements.

Security

We use commercially reasonable administrative, technical, personnel, and physical security measures designed to safeguard Personal Information in our possession against loss, theft, and accidental or unlawful destruction, as well as unauthorized use, disclosure, and modification. Please keep in mind, however, that whenever you give out Personal Information online, such information is not always secure in transit. While we take reasonable measures to protect Personal Information, we cannot guarantee the security of information sent over the Internet or through a mobile application, and you disclose such information at your own risk.

Children's Data

Bida is designed for educational use by a parent or legal guardian, family member, caregiver, or any other authorized individual as the case may be, for the purposes of tracking and supporting the development of a Child in their care. The App is not intended to be used independently by Children, and we do not knowingly allow any child to register as a User and create an account without the appropriate consent of a parent, legal guardian or authorized individual.

User accounts and Child profiles within the App are created and managed by Users who represent that they are authorized to provide such information and to act on behalf of the Child. We rely on Users to provide accurate information and to obtain any necessary consent or authorization where applicable.

If we become aware that Personal Information has been collected from a Child without the required authorization and consent, we will take appropriate steps to delete such Personal Information promptly.

We process Children’s Personal Information solely for the purposes described in this Privacy Policy and in a manner designed to protect the privacy, safety and best interests of children.

Parental and Guardian Consent

In accordance with the laws and regulations of the State of Kuwait, Personal Information of Children under 21 years of age is collected and processed only with the authorization of their parent or legal guardian. By creating or managing a Child Profile and providing child-related information through the App, Users confirm that, if they are not the parent, legal guardian or any other authorized individual in relation to the Child, they have obtained parental or guardian consent and that they are authorized to provide such information in accordance with applicable law.

User Rights

Subject to applicable law, you may:

  • Request access to your or your Child’s Personal Information;
  • Request correction of inaccurate or incomplete Personal Information;
  • Request deletion or restriction of processing;
  • Withdraw consent at any time; and
  • Request a copy of the data in portable format.

Notwithstanding point 4 above, you may only submit the above requests on behalf of the Child if you are authorized to do so. In cases where an unauthorized individual creates a Child Profile, the authorized individual of the relevant Child shall have the right to submit the above requests.

Push Notification and Device Permissions

The App may request permission to send notifications for reminders or updates. You may disable notifications at any time through your device settings. We do not access any other device feature (camera, microphone, contacts or location) unless specifically initiated by the User for Notes, Media, and User-Generated Content purposes as explained above, and only after obtaining your express consent.

Acceptance of this Privacy Policy

By accepting the terms and conditions of this Privacy Policy, you acknowledge that you have read, understood, and agreed to this Privacy Policy. Your use of the App constitutes your consent to the collection, use, processing, disclosure, and retention of your and the Child’s Personal Information as described in this Policy and in accordance with applicable laws and regulations of the State of Kuwait.

If you do not agree with this Policy, please discontinue use of the App and contact us for assistance in deleting your account and the Bida App if you had downloaded it.

Changes to this Privacy Policy

From time to time, we may modify this Privacy Policy to reflect industry initiatives, changes in legal requirements, changes in our information collection and use practices, or changes in the operation of the Bida App and Bida Platform, or for any other reason we deem fit. Any material changes will be communicated through the App, and the “Effective Date” at the top of this Privacy Policy will be revised accordingly. Continued use of the App following publication of an updated Privacy Policy constitutes acknowledgment and acceptance of the revised terms.
